PLEASE READ THE FOLLOWING PRIVACY POLICY CAREFULLY BEFORE USING THE EDGEDWARRIORARTS. COM website herein referred to as the “Site.” All general users and registered end users of this Site agree that access to and use of this Site including purchasing any and all items from this Site are subject to the following Privacy Policy. If the general user or registered end user does not agree to this Privacy Policy, please do not use the Site or purchase items from this Site.  Purchasing an item from this Site constitutes full acceptance of the Terms and Conditions of Use and Privacy Policy of the Site by a registered end user.

Company Name

Executive Martial Arts is a registered company in the state of Tennessee.  Executive Martial Arts does business as Edgedwarriorarts.com.

General Information

This Privacy Policy describes how the Site handles administration of a registered end user’s personal information for the Edgedwarriorarts.com website. The Privacy Policy applies generally to information collected on the Site or through the use of the Site. By accepting the Privacy Policy and the Terms and Conditions of Use Agreement, the registered end user expressly consent to the Site’s collection, use, storage, and disclosure of the registered end user’s personal information as described in this Privacy Policy. This Privacy Policy is effective upon acceptance for registered end users and is otherwise effective on April 1, 2015.

Changes to This Privacy Policy

The Site reserves the right to make changes and revisions to this Privacy Policy.  Should the Site revise any material changes in the way the Site uses your Personal Data, the Site will notify the registered end user by sending the registered end user an e-mail to the last e-mail address provided on file and/or by posting notice of the changes to the Site. Any and all changes to this Privacy Policy will be effective upon the earliest of thirty (30) calendar days following the sending of an e-mail notice to the registered end user or thirty (30) calendar days following the posting of notice of changes to the Site. The reported changes will be effective immediately for all Site general users and registered end users.

Please note that at all times you are responsible for updating your Personal Data to provide us with your most current e-mail address. In the event that the last e-mail address that you have provided us is not valid, or for any reason is not capable of delivering to you the notice described above, our dispatch of the e-mail containing such notice will nonetheless constitute effective notice of the changes described in the notice. In any event, changes to this Privacy Policy may affect our use of Personal Data that you provided us prior to our notification to you of the changes. If you do not wish to permit changes in our use of your Personal Data, you must notify us prior to the effective date of the changes that you wish to deactivate your account with us. Continued use of our Website or Service following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.

Under Age Individuals (Minor) Usage

The Site is not intended for minor.  The Site will not accept orders for any materials, equipment, or products from minors classified as those individuals under the age of 18.  Should a registered end user falsify their age in order to gain access to order materials, equipment, or products from the Site, the falsification of age voids and invalidates the transaction.  Furthermore, the falsification of age by the registered end use indemnifies, defends, and holds harmless the Site, its officers, directors, employees, agents, licensors, and suppliers (collectively known as the “Site Service Providers”) from and against all losses, expenses, damages and costs, including all attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to the registered end user account (including negligent or wrongful conduct) by the registered end user or any other person accessing the Site using the registered end user Internet account and end user credentials.  If the general user is under the age of 18, then that general user should employ the involvement of a parent or registered guardian when using the Site.

Data Collection

Personal data represents data that allows someone to identify or contact the registered end user, including but not limited to the registered end user’s first and last name, address, telephone number, e-mail address, as well as any other non-public information about the registered end user that is associated with or linked to any of the aforementioned data types. Anonymous data signifies collected data that is not associated with or linked to the registered end user’s personal data. Anonymous data does not, by itself, allow for the identification of the registered end user. The Site collects personal and anonymous data, as described in the different sections below.

A general user may peruse the Site without identifying to the Site as to whom the general user is or revealing any personal data about the general user. Once the general user provides to the Site personal data, then the general user is no longer anonymous to the Site and becomes a registered end user. If the general user chooses to provide the Site with personal data, then the general user understands that they become a registered end user whereby the newly registered end user consents to the transfer and storage of their personal data information on the Site’s servers located in the United States.

Information Shared to the Site

Some but not all of the registered end user’s personal data information provided to the Site in the account creation process, such as the registered end user’s full name, may be displayed throughout the Site therefore available to the public and connected to all of the registered end user’s Site activity. The Site reserves the right to send notices sent to other Site registered end users about suspicious activity and policy violations on the Site.

If the registered end user chooses to access the Site from a shared computer or a computer terminal in an Internet café or any other public internet setting, please know that certain personal data such as information about the registered end user may also be visible to other individuals who use the computer after the registered end user.

Information Collected though Technology Applications.

To enhance the user experience, the Site’s servers, which may be hosted by a third party service provider, gather information from the registered end user, including the registered end user’s browser type, phone, device, tablet, or computer’s operating system, the date and time stamp notation for the registered end user’s presence on the Site, domain name, and the Internet Protocol (IP) address.  An IP address, the number randomly generated and assigned to the registered end user’s device, may vary each time the registered end user accesses the Site.

The Site may choose to use gathering mechanisms, cookies, and other URL information to collect information regarding the date and time of the registered end user’s presence on the Site and the specific information and areas by which the registered end user perused and searched when viewing the Site. The gathering mechanism, a cookie, consists of small informational bits that the Site transmits to the general user or registered end user’s device while the use views the Site. The Site may choose to utilize a session cookie, a mechanism that expires once the user closes their internet web browser, and/or a persistent cookie, another mechanism that resides on your device until the user chooses to delete the persistent cookie.  These two cookie mechanisms permit the ability for a user to have a more interactive end user experience on the Site.  The persistent cookie can be removed by following the user’s selected Internet browser help directions.

Information Collected From Third Party Companies.

The Site may choose to receive information containing personal and/or anonymous data about a general user or registered end user from third party companies. The Site may add this information to the information previously collected by the Site from the general user or registered end user through the Site as a means to enrich the Site’s user experience.

Personal Data Access, Review, and Change

The registered end user may change any of their personal data in their account by editing their profile within their account. The registered end user may request the Site to delete personal data, but please note that the Site may be required to keep this information, defined as personal data, and not delete the personal data.  Upon receipt of the registered end user’s request, the Site will close the registered end user’s account and remove their Personal Data from view as soon as reasonably possible, based on the registered end user’s account activity and in accordance with applicable law. The Site does retain personal data from closed accounts to enforce the Site’s Terms and Conditions of Use agreement, to assist with investigations, to trouble shoot registered end user problems, to resolve disputes, to comply with law, to prevent abuse and fraud, to collect any fees owed or past due fees, and to take other actions otherwise permitted and permissible by law.

Personal Data Usage

By accepting the Site’s Terms and Conditions of Use, the registered end user accepts the Privacy Policy. Part of the acceptance of the Privacy Policy includes agreement to the Site using the registered end user personal data. The Site may use the registered end user’s personal data for, but no limited to, the following actions: transmit to the registered end user an introduction electronic mail to validate the ownership of the electronic email provided when the registered end user created the new account; provide customer service support; provide identification of the registered end user in the Site’s system; calibrate, tailor, and enhance the registered end user Site experience; distribute Site communications and updates, counter, observe, and research possible illegal or otherwise prohibited activities; conclude disputes; handle registered end user problems; complete fee collection activities; compare information for third party verification; and any other activities as described upon collection by the Site.

Anonymous Data Usage

The Site may choose to create anonymous data records from collected personal data by excluding and de-identifying information (such as your name, address, etc.) that makes the data personally identifiable to the registered end user. The Site may choose to use these anonymous data records to analyze click requests and usage patterns within the Site to further augment and enhance the user experience in terms of navigation and content available to Site users. The Site reserves the right and sole discretion to use anonymous data for any purpose and disclose anonymous data to third parties whereby the Site deems appropriate.

Personal Data Disclosure  

The Site may choose to disclose registered end user personal data in order to communicate on items relating to legal requirements, to enforce the Site’s Terms and Conditions of Use, or protect a registered end user’s rights. The personal data information that the Site discloses will follow in accordance with applicable State laws and regulations.

Please be aware that the Site may also share your personal data with local, state, and federal law enforcement agencies or organizations; local, state, or federal government agencies; or other authorized third-parties in response to validated requests relating to potential criminal investigations of alleged illegal activity or other nefarious activity which may exposure the Site, registered end user, or other Site registered end users to legal liability. Should an event arise, the Site has the authority to disclose personal data information related to the specific investigation such as registered end user’s name, address, city, state, zip code, electronic mail address, applicable telephone number(s), registered end user Site name, device IP address, and/or any other information the Site determines relevant to the investigation.

Security

The Site utilizes standard electronic commerce protocols, practices, and technologies not limited to Secure Socket Layers (SSL), data encryption methodology, and firewall protections.  The Site does not guarantee that information transferred over the Internet will be 100% completely secure.  Herein, the Site utilizes different security techniques to protect the registered end user’s data from unauthorized access by users inside and outside of the Site.  The Site does not ensure or warrant the security of any information that the registered end user transmits to the Site and therefore the registered end user does so at their own risk.

During the item, material, equipment, or product electronic commerce checkout process, a registered end user should check that their specific web browser of choice has established a secure connection to the Site’s host server system.  A padlock symbol or icon typically will appear in one of the corners of the registered end user’s web browser window depending upon the registered end user’s web browser.

The registered end user’s password provides the key for entry into the registered end user’s account. The Site requests that the registered end user does not disclose their Site password to anyone other individual. Should the registered end user share their password or their personal data with individuals voluntarily, then that original registered end user is solely responsible for all actions taken in the name of the original registered end user account. If the registered end user loses control of their password, the registered end user may lose substantial control over their personal data and may be subject to legally binding proceedings and actions taken on behalf of the registered end user. Therefore, should your password be compromised for any reason, the registered end user is advised to immediately notify the Site and promptly alter their prior established password.

Third Parties Disclosure

Except as otherwise expressly included in this privacy policy, this document addresses only the use and disclosure of information that the Site collect from the registered end user. The Site does not disclose the registered end user’s personal data to third party sites.
